PHILIP W.7 REED (Lemuel6, Anna5, Thomas4, William3, James2, William1 ) was born at Dartmouth, Bristol County, Massachusetts, on 1808[1] a son of Lemuel Reed and his wife Falley Woodmansee, and died at New Bedford, Bristol County, on 5 January 1874.[2] He married first at Dartmouth on 23 February 1826 HARRIET WHALON.[3] She was born at Dartmouth on 14 February 1809, a daughter of Daniel and Hannah Whalon.[4] Philip married second at New Bedford on 14 November 1863 EMALINE SEEKELL.[5] She was born at Freetown, Bristol County, on 28 February 1838, a daughter of William Seekell and his wife Delany Pittsley. She died at Fairhaven, Bristol County, on 6 June 1915.[6]

Philip Reed, the oldest of thirteen children, lived most of his life in the neighboring towns of New Bedford and Fairhaven. He worked as a stone mason. The few details of his life speak of debt and poverty.

Philip's grave marker places his birth in 1808. Other records vary greatly: he was reported as forty years old in the 1860 Census, fifty-four at the time of his marriage in 1863, fifty in the 1865 state census, and sixty-four in the 1870 Census. Perhaps the underestimates of his age were made to reduce the age discrepancy between Philip and his wife.

Philip married Harriet Whalon when he was about eighteen years old and she was seventeen. Three years later, Harriet's sister Clarissa married Philip's brother Stephen, binding the two families more closely together.

The 1830 Census reportred Philip Reed at Dartmouth, the head of a household consisting of a man and a woman in their twenties, and two boys under five.[7] One of those boys we can identify as Philip H. Reed, age two years at the time. Perhaps there was another son, who died young, as we have no further record of another child. I do not know what happened to wife Harriet as I find no further record of her.

When Philip's father Lemuel B. Reed died in June of 1849 without a will, his property would pass by law to his thirteen children, with one third set aside for his widow for her lifetime (the "dower"). Philip had unpaid debts, and his creditors saw the opportunity to collect from the estate of Philip's father. This forced the family to take action to have the property divided. On 25 March 1830 Philip borrowed from Richard Mosher $24.63, which he did not pay back. On 18 April 1832 Philip had borrowed $105.00 from Abner B. Gifford, to be paid back in $15.00 quarterly installments with interest. Which he did not do. By 1849 both of Philip's creditors had died, and the administrators of their estates sued in court for the money owed and more. In November, 1849, Philip Reed did not appear in court to defend himself, and the court found in favor of the creditors. Meanwhile, the widow's dower had been set aside from the rest of Lemuel's estate. Philip was ordered to be placed in jail until the debt was paid, this order was made on Christmas eve, 24 December 1849. In January 1850 appraisers were appointed and Philip's property seized. As the estate of Lemuel Reed had not yet been divided among the thirteen children, this placed all the property in jeapordy. In March 1850 some of the other children petitioned probate court to have the property divided, which was done on 15 June and granted by the court on 6 August. The court record follows:[8]

In a plea of the case for that said Reed on the Eighteenth day of April, Eighteen hundred and thirty two, by his note in writing for value received promised the said Abner B. Gifford, who was then in full life, but since deceased, to pay him on order, one hundred and five dollars: to be paid fifteen dollars, on the first day of November then next, and fifteen dollars at the end of every ninety days thereafterwards until the whole sum aforesaid is paid with interest. Yet he has not paid the same. To the damage of the said Plf, in his said capacity, as he says, the sum of five hundred dollars.
This action was entered at the September term last past and was from thence continued to this term -- Now the Plf appears -- The Dft though called, doth not appear, but makes default. It is therefore considered by the Court that the said Gifford, Admr, recover against the said Reed the sum of two hundred and seventeen dollars and forty seven cents, damage, and costs of suit taxed at $15.80.

This action was entered at the September term last past, and was from thence continued to this term. -- Now the Plf. appears. The Dft, though called, doth not appear, but makes default -- It is therefore considered by the Court that the said Gifford recover against the said Reed the sum of twenty one dollars and eighty nine cents damage, and cost of suit taxed at $ 15.80.

Gifford of Westport in said County, Yeoman, Administrator of the goods and estate which were of Abner B. Gifford, late of said Westport, deceased, and intestate, at the time of his decease, by the consideration of our Justices of our Court of Common Pleas holden at New Bedford for and within our County of Bristol aforesaid on the second Monday of December inst. on the 22 day of said month, recovered judgment against Philip Reed, of Fairhaven, in said County, Yeoman, for the sum of two hundred and seventeen dollars and forty seven cents damage, and fifteen dollars and eighty cents costs of suit, as to us appears of record, whereof Execution remains to be done: We command you, therefore, that of the goods, chattels or lands of the said Reed, within your precinct, you cause to be paid and satisfied unto the said Gifford, Adm., at value thereof in money, the aforesaid sums, being two hundred and thirty three dollars and twenty-seven cents in the whole, with interest from the date of said Judgment, with twenty five cents more for this writ: and thereof also to satisfy yourselves for your own fees: and for want of goods, chattels or lands of the said Reed to be by him shown unto you, or found within your precinct, to the acceptance of said Gifford, Admr to satisfy the sums aforesaid--We command you to take the body of the said Reed and him commit unto our Gaol at Taunton or New Bedford in our County of Bristol aforesaid, and detain in your custody, within our said gaol, until he pay the full sum above-mentioned, with your fees, or that he be discharged by the said Gifford, Admr the creditor, or otherwise by order of law. Hereof fail not, and make return of this writ, with your doings therein into our said Court of Common Pleas to be holden at Taunton within and for the County of Bristol aforesaid, upon the second Monday of March next. And we have appraised said Real Estate as follows, to wit: The first two lots above described at the sum of one hundred and sixty-five dollars, and the other lots, being the dower land, at the sum of sixty dollars, making in all the sum of two hundred and twenty five dollars: meaning and intending this as the value of the estate and interest of the said Debtor in said land; which sum is less than the amount of this Execution, and have set off the same by metes and bounds to the said Jonathan P. Gifford, Administrator, to hold to him his heirs and assigns forever.

By virtue of this Execution, I this day seized the real Estate described in the foregoing Certificate of the Appraisers, and having on the same day notified the within named Philip Reed, the Debtor, to choose and appoint an appraiser and he refusing to do so, I appointed Joseph Gifford of Dartmouth in said County, and James Reed, of Westport, in said County, as appraisers, and the Creditor within named chose and appointed Nathan C. Brownell of said Westport and on the twenty first day of said month I caused said persons, being three disinterested and discreet men to be sworn as Appraisers, as appears above; and the said Nathan C. Brownell, Joseph Gifford and James Reed, having been first thus duly sworn faithfully and impartially to appraise such Real Estate as should be shewn to them, as taken by force of this Execution; and the Real Estate above described in the foregoing Certificate of the Appraisers, which is to be referred to for a description, having been so shewn to them and to me by the said Jonathan P. Gifford as the estate of said Philip Reed, proceeded with me to view and examine the same so far as necessary to form a just estimate of its value, and appraised it at the sum of two hundred and twenty-five dollars, being less than the amount of this Execution, and set off said real estate by metes and bounds to the said Jonathan P. Gifford, Administrator, to hold to him, his heirs and assigns forever. All of which appears by the Certificates above written of the administration of the oath and the doings of the Appraisers, which are hereby referred to and made a part of this Return. And I this day levied this Execution upon said real estate described as aforesaid, and delivered seizen and possession thereof to the said Jonathan P. Gifford, the Creditor, to hold to him and his heirs and assigns forever, in full satisfaction of this Execution as appears by his receipt hereon.
And so I return this Execution in part satisfied, only, viz: for the sum of two hundred + four + 72/100 dollars, together with my fees, and unsatisfied as to the remainder.

According to the above documents, Philip Reed resided in Fairhaven in 1849. The next record that I can say with confidence relates to this Philip Reed is the 1860 Census, which reported Philip Reed, 40, stone cutter, in New Bedford, with Eveline Reed, 20, and Alice Reed, 2.[9] Philip Reed married Emaline Seekel at New Bedford in 1863, when he was 54 and she 23. However, they already had two children by that date. Their first child was born when Philip was about fifty and Emaline about twenty. By the time of the 1865 state census the family was living on Sconticut Neck Road in Fairhaven, in proximity to Emaline's mother and other relatives.[10] Emaline had been born in Freetown, the fourth of seven children; by 1850 her family had moved to Fairhaven.

The 1870 Census reported the Philip Reed family at Fairhaven immediately after Emaline's mother. Philip, 64, was a stone mason with real estate valued at $300; Emaline, 29, was keeping house; Alice, 12, and Ezekiel, 8, were attending school; Allen, 4, and Emaline, 1, were at home.[11]

Philip Reed died in 1874 from heart disease.[12] According to the family, his remains were placed in a paupers' grave. Later, when his widow had the money to bury him properly, she purchased a cemetery plot at Naskatucket Cemetery in Fairhaven. However, it could not be determined which bones in the paupers' grave were his. So there are no remains under his grave marker at Naskatucket Cemetery.[13] At Philip's death, Emaline, age 35, was left with children ages 15, 12, 7, 4, and ten months. She continued to raise her family in Fairhaven, surrounded by members of her extended family.

Emaline Reed's family appears in the 1880 Census at Fairhaven, immediately after her mother and immediately before her brother:[14]

According to her birth record, Emaline was 42 years old, born in 1838.

The children were soon marrying and moving away. Alice married in 1880, Julia in 1889, daughter Emaline in 1890, Allen and Ezekiel in 1892. The 1900 Census reported Emaline Reed, 51, living with her daughter, Emaline (Reed) Hoyt, son-in-law James Hoyt and grandson James Hoyt, at New Bedford. According to this record, mother Emaline had seven children, five of whom were living.[15] The other two must have died in infancy, as they are not reported in any census. That census reported daughters Alice and Julia living near each other near or at the old home place on Sconticut Neck; Ezekiel had moved to Dartmouth. I do not find Allen in the 1900 Census, but by 1910 he was living on one of the Elizabeth Islands, on the south side of Buzzards Bay.

According to Julia's daughter, Dorothy "Dot" (Hathaway) Lang, Emaline was diabetic, and about 1907 moved in with daughter Julia, who cared for her. Dot recalled:

Diabetics were worse off then, compared to today. There was no insulin. They had to control their sugar with diet. They had to eat a special glutten bread. When you take a bite it all squishes to nothing in your mouth.[16]

However the 1910 the census reported Emaline Reed living with her son Allen in the Town of Gosnold, which is the Elizabeth Islands.[17]

Emaline (Seekell) Reed died in 1915 at Fairhaven, from diabetis mellitis, a contributing cause being valvular heart disease.[18]


QUESTION

Was the Philip Reed who married Harriet Whalon in 1826 and Emaline Seekel in 1863 the same Philip Reed reported in the 1850 Census in Fairhaven apparently married to Sarah?

First, we can say with confidence that the Philip Reed who married Harriet is the same Philip Reed who married Emaline. A Philip H. Reed, of Dartmouth, died in 1896 and his death record identifies his parents as Philip and Harriet. The will of this Philip H. Reed identifies Emaline Reed as his step-mother, and lists the children of Philip and Emaline as his half-brothers and half-sisters.

The 1850 Census reported a family of Philip Reed living at Fairhaven, with the same occupation and approximately same age as the Philip Reed who married Harriet and Emaline:[19]

What else can we learn about this family of Philip and Sarah?

There is one other record, which could refer to either Philip Reed, if they are in fact two different people. In March of 1859 Warren Reed of Fairhaven sued Philip Reed of Fairhaven for $75.80 damages plus $13.70 cost of suit. In April a piece of property on Chestnut Street in Fairhaven was turned over to Warren Reed.[30] Warren was a younger brother to the Philip Reed who married Emaline.

The above information indicates that a Philip Reed married Sarah Ann Raymond, who came from either Middleboro or Plymouth. The 1850 Census record is a record of this couple and their children. Philip Reed may have been born at Westport. This family resided in Fairhaven in 1840, 1850, and 1855. I find no convincing record of this Philip, Sarah, or any of their children in the 1860 Census or later censuses.

In conclusion, I cannot say with any degree of confidence that they were or were not the same Philip Reed.


PHILIP H. REED


Capt. Philip H. Reed

Philip H. Reed, son of Philip W. Reed and his first wife Harriet Whalon, spent most of his adult life engaged in the whaling fishery, many of those years at sea. He first went out at the age of twenty-two on the Young Phenix, leaving New Bedford in 1849 and returning in 1853. After the Civil War he departed from San Francisco, California, as master of a brig, and later served several whalers from New Bedford as master, and as agent, responsible for the business affairs of the vessel. As an agent, he did not necessarily go to sea. He served on the following vessels:[31]

Philip H. Reed married twice, both times to first cousins, and had no children. In 1873, when he was forty-five years old, he married Mary Levina Tripp, age twenty. Philip's father, and Mary Levina's mother were brother and sister. Mary Levina died seven years after their marriage. In 1886, at tha age of fifty-eight, Philip H. Reed married Melvina F. Reed, age twenty-one. Melvina's father, Warren, was a brother to Philip's father. Philip lived ten years after this marriage. A year after his death Melvina married George Gifford. George died in 1923, Melvina lived to 1944.

The 1870 Census reported Philip H. Reed living with Peleg and Mary Ann (Reed) Tripp. Also in the home was Mary Levina Tripp, whom Philip would marry in three years.[32] Mary Levina was the daughter of Peleg and Lavina (Reed) Tripp. Lavina was a sister to Philip's father Philip. Lavina died six months after Mary Levina's birth. Five years later Peleg married Lavina's sister Mary Ann. That is the only census that appears to have found Philip on dry ground.

Philip H. Reed wrote his will on 2 August 1893, and it was proved con 5 June 1896. The will reads:[33]

Know all men by these presents,
That I, Philip H. Reed of Dartmouth in the County of Bristol and Commonwealth of Massachusetts do hereby make this my last will and testament hereby expressly revoking any and all wills heretofore made by me.
After the payment of my just debts and funeral expenses, I give devise and bequeath and provide as follows;--
I designate and appoint my wife Melvina F. Reed to be the executrix of this will and request that she may be exempt from furnishing surety or sureties upon her official bond as such.
I hereby instruct my said executrix to curb with suitable stone curbing my lot in the Linden Grove Cemetery in said Dartmouth, and to erect upon said lot a monument of suitable proportions and design, and I give and devote to these purposes the sum of eight hundred dollars. If at the time of my death this work shall have been completed then this provision of my will is void. If it is not then fully completed I authorize and instruct my said executrix to finish said work, the whole to cost not exceeding said sum of eight hundred dollars.
I give to the trustees of the Peleg W. Peckham Cemetary Fund the sum of one hundred dollars the same to be held by them in trust for the purpose of devoting the income thereof for the perpetual care of my cemetery lot in the Linden Grove Cemetary aforesaid.
I give to my said wife, Melvina F. Reed, my homestead now occupied by me, with all lands and buildings appurtinant thereto, the same being situated in said Dartmouth, for and during her lifetime. After the death of my said wife, I give and devise the same to Mary Lavinia Tripp, in fee simple, but should the said Mary die without heirs, then I give and devise the same to my half brothers and sisters, share and share alike, to wit, to Alice R. Mara, Ezekiel W. Reed, Allen H. Reed, Emeline Hoyt and Julia L. Hathaway.
I give and bequeath to the following named persons the sums set against their respective names:--

Ezekiel W. Reed, half brother, one hundred dollars
Allen H. Reed, half brother, one hundred dollars

Emeline Reed, step mother, two hundred and fifty dollars, but if she shall not be living at the time of my decease, said legacy shall lapse and go into my estate for distribution as hereinafter provided.
I give, devise and bequeath to trustees to be appointed by the Probate Court in and for the County of Bristol in trust nevertheless for the following named purposes, the sum of five thousand dollars, to invest the same conservatively and to pay to my said wife during her lifetime the income of the same as it shall accrue, and after her death, to pay in equal portions to the following named persons or their legal representatives, said sum of five thousand dollars, free and discharged of all trusts; to wit,--to Alice R. Mara, Ezekiel W. Reed, Allen H. Reed, Emeline Hoyt and Julia L. Hathaway.
All the rest and residue of my property both real and personal, I give, devise and bequeath to my said wife Melvina F. Reed, absolutely and in fee. The provisions made herein for my said wife are in lieu of dower and other statutory interests in my estate.
I give to the trustees to be named under this will full power to make such changes in investments as they may deem wise and to make and execute any papers necessary thereto--

The reader might be confused to see the name of Philip's deceased first wife mentioned. Peleg Tripp, a first cousin to Philip H. Reed and also a first cousin to Philip's first wife, Mary Levina Tripp, had a child whom he named for his cousin, Mary Lavina Tripp, born the same year her namesake died. This second cousin is the Mary Levina Tripp named in his will. Josephine L. (Reed) Rogers was another cousin, the only surviving child of his uncle Andrew's first marriage.

The inventory of Philip H. Reed's estate included 10/32 of the bark Petrel and 12/32 of unsold oil from the bark Petrel.


CHILDREN OF PHILIP AND EMALINE

Alice Reed married at the age of twenty-two Joseph Manuel Marra. Born in the Azores, Joseph came to America in 1868 and worked as an iron miller and farmed.[34]

Ezekiel Reed, at the age of thirty, married his first cousin, Emma Agusta Reed, daughter to Philip's brother Allen Reed. Ezekiel farmed in Dartmouth and later worked as a foreman on the state highway.[35]

Allen Reed, son of Philip and Emaline, lived for a while on the Elizabeth Islands and fished. Later he moved to New Bedford and worked in boat yards.[36]

Emaline Reed married James Hoyt and lived in New Bedford. He was described in various censuses as a mariner, ship's carpenter, and house carpenter.[37]

Philip Reed and his first wife had the following child:

Philip W. Reed and his second wife Emaline Seekell had the following children:
